Big Changes to Hemp Coming in 2026: What You Need to Know

In true Washington fashion, Congress just passed a funding bill to avoid a government shutdown, and quietly slipped in a major curveball for the hemp industry.

So, what’s the deal? H.R. 5371 just redefined what “legal hemp” means at the federal level. It was hidden deep in the fine print, but it’s going to have huge ripple effects, especially for companies selling THCA and other “intoxicating hemp products”.

Here’s the Quick & Dirty:

• Total THC now includes THCA: That’s right, the legal limit of 0.3% THC now includes decarboxylated THCA.
• A 0.4 mg per-container cap: This limit on total THC and anything with similar effects (like Delta-8, Delta-10, etc.) is a gut punch to intoxicating hemp products.
• Converted cannabinoids? Out. If a cannabinoid didn’t come straight from the plant, or was converted or synthesized, it’s not considered lawful hemp anymore.
• 365-day grace period: We’ve got until November 12, 2026 to adapt.
